Part One Class Description / 第一部分 课程描述

Negotiation Theory and Practice - As you train to become a lawyer, you will need a wide range of skills.  Most of the work you will do will involve some type of negotiation, whether it is with another attorney, a judge or your own client.  You also negotiate in all aspects of your personal life with your family, your friends, and yourself.

This 6 class course will present the theory and practice of negotiation.  This course will train you in the 5 keys to the theory and practice of negotiation: (1) understanding how our brain makes sense of the world around us;  (2) emotional and social intelligence; (3) putting our beliefs into action with ethics; (4) framing the problem in broader, more positive terms and; (5) generating a wide range of options. The class will be a combination of lecture, readings and group activities.  By the end of the class students should feel confident and competent in most negotiation settings.

你要想成为一名合格的律师,就需要具备一系列技能。不管是面对另一位律师、法官还是你自己的客户,你要做的大部分工作都涉及到谈判。你也在日常生活中面临各种各样的谈判,比如与家人之间,与朋友之间,甚至与你自己。

本课程一共654学时,将包括谈判的理论和实践两个方面。本课程将在如下五个关键领域对你进行训练:(1)理解我们的大脑是如何理解我们周围的世界的;(2)在符合伦理规范的情况下,把我们的信息溶入我们的行为中;(3)在更广和更积极的范围内界定问题;(4)提出范围很广的选择项。课程将采用讲座、精读材料和小组活动的方式进行。希冀在课程结束时,所有学生都变得更自信,并能面对绝大多数的谈判场合。

 

Part Two  Syllabus /第二部分 课程表

 

First Class / 第一次课

Time / 时间:2012/3/10 (周六)

Topics / 主题:

8:00-12:00 Traditional Conflict Resolution/ 传统纠纷解决方式

The class begins by developing our understanding of traditional conflict resolution.  We will look at conflict theory, the spectrum of conflict resolution, conflict resolution styles and categories, and five basic methods for resolving conflict.

 

2:00-18:00 Alternative Dispute Resolution / 替代争端解决方式

Alternative Dispute Resolution considers peaceful methods for resolving conflicts.  We will explore free will, learning styles, brain function, social conflict, the nature of trust and ethical behavior.

 

Second Class / 第二次课

Time / 时间:2012/3/24 (周六)

Topics / 主题:

8:00-12:00 Communication / 沟通

Communication begins with listening and understanding, which leads to clarifying misperceptions and asking better questions.  We will practice these skills of communication in resolving difficult issues.

 

2:00-18:00 Emotional Intelligence / 情商

Conflict resolution is as much about emotion as it is about the issues.  Emotional Intelligence (EQ) is about understanding how to be aware of our emotions as well as how to manage them.

 

Third Class / 第三次课

Topics / 主题:

8:00-12:00 Culture and Gender / 文化和性别

Understanding our cross cultural relationships will allow us to resolve a much broader range of issues and work with a wider range of people.

 

2:00-18:00 Ethical Decision Making / 决策中的伦理

Ethics engenders understanding of the consequences of our actions.  In this session we will apply our values to our decisions, and consider what we believe and what choices are available to us.

 

Fourth Class / 第四次课

Time / 时间:2012/4/21 (周六)

Topics / 主题:

8:00-12:00 Facts, Framing and Choices / 事实、边界和选择

Gathering all of the facts allows us to come to complete understanding of a situation.  Framing allows us to see the situation in a way that is positive and future focused.  Choices will generate a variety of options.

 

2:00-18:00 Negotiation Role Play / 谈判角色扮演

Role Plays allow us to be parties in a negotiation, and practice the skills we have been learning.

 

Fifth Class / 第五次课

Time / 时间:2012/5/5 (周六)

Topics / 主题:

8:00-12:00 Impasse and Agreements / 僵局及协议

Impasse is when parties aren’t able to resolve an issue.  We will practice the skills needed for these very difficult problems and how to get to agreements.  Agreements need to be specific, complete and durable.  We will practice writing agreements for the cases we have negotiated.

 

2:00-18:00 Reciprocal Negotiation Role Play ( Part I ) / 互惠性谈判角色扮演(第一部分)

Role Plays allow us to be parties in a negotiation, and practice the skills we have been learning. Reciprocal Negotiation is style that generates a wide variety of options through recognizing the needs of each other.

 

Sixth Class / 第六次课

Topics / 主题:

8:00-12:00 Reciprocal Negotiation Role Play ( Part II ) / 互惠性谈判角色扮演(第二部分)

Role Plays allow us to be parties in a negotiation, and practice the skills we have been learning.  In this class, we will focus on advanced negotiation practices.

 

2:00-18:00 Professional Ethics / 职业伦理

In our last class we will explore the current Model Standards of Conduct for mediation and ethical guidelines for negotiators.

Part Four  Teachers /第四部分 任课老师介绍

Trip Barthel / 崔普.巴特尔

Trip Barthel was the Founder and Executive Director (1999-2009) of the Neighborhood Mediation Center in Reno, Nevada.  Trip has an M.A. in Conflict Resolution and enjoys conducting imaginative and interactive teaching and training experiences at conferences, schools and around the world. Trip has worked in India, Malaysia, Russia and Eastern Europe.  Trip is an Adjunct Professor at the University of Nevada, where he created and teaches the Beginning and Advanced Conflict Resolution Certification Program from 2003 to the present.  He has also been an adjunct faculty professor for National Judicial College, where he trained international judges in mediation and conflict resolution.

崔普.巴特尔Trip Barthel)是位于美国内华达州里诺市的邻里调解中心the Neighborhood Mediation Center)的创始人和主席(1999-2009)。他取得纠纷解决的硕士学位,并热心于在研讨会、学校等举办富有创意的互动式教学。他在印度、马来西亚、俄罗斯和东欧工作过。他是美国内华达大学(the University of Nevada)的兼职教授,2003年他在该校创设纠纷解决初级和高级证书项目the Beginning and Advanced Conflict Resolution Certification Program),并一直担任教职。他还是美国国家法官学院(National Judicial College)的兼职教授,并在该院训练调解和纠纷解决的国际法官。

 

Liu Yongpei / 刘永沛

Liu Yongpei graduated from Peking University Law School and acquired PhD degree there (2006).  He has the experience of working and doing research in United States: Cohen, Pontani, Liberman & Pavane LLP,  New York (2003), University of California-San Diego (2008).  From 2006 to present, he teaches in KoGuan Law School in Shanghai Jiao Tong University (SJTU) and works as executive director of Legal Experiential Education Center. He has finished dozens of articles in the area of Intellectual Property and experiential education.  He teaches intellectual property and legal negotiation course for undergraduate and graduate students.

刘永沛毕业于北京大学法学院,获法学博士学位,并在美国CPLP (Cohen, Pontani, Liberman & Pavane LLP,  New York) 律师事务所、加州大学 (University of California-San Diego) 访问研究和工作过;从2006年起在上海交通大学法学院工作,现任法律实验教学训练中心(Legal Experiential Education Center执行主任。他为本科生和研究生生开设知识产权法和法律谈判课程。

3. Candidates of Intercollegiate Negotiation Competition (2012, Tokyo)

4. Candidates of Jessup International Law Moot Court Competition (2012);

5. Candidates of Moot Shanghai (2013, Shanghai);

6. Candidates of Intercollegiate M & A Moot Competition (2013, Taipei);

7. Other students who has strong Interest and curiosity on negotiation program.
